UPDATE: Florida’s Newest Restrictions on Gender-Affirming Care

We’ve got some important (and frustrating) news to share. On August 26, 2024, the 11th Circuit Court of Appeals issued a stay on a previous federal district court decision. This means Florida is now allowed to enforce its restrictive laws on gender-affirming care until the court hears the state’s appeal of the district court decision that found Florida’s anti-trans laws (SB 254) unlawful. These laws specifically ban care for transgender and gender non-conforming (TGNC) minors and make it harder for adults to access the care they need.

In plain terms, while the court continues to mull over Florida’s appeal against a ruling that declared the state’s anti-trans law, FL SB 254, unlawful, these harmful laws are still in effect.

What Does This Mean for You?

  • In-Person Consent Form Signing is Required: If you’re starting or continuing gender-affirming hormone therapy (GAHT) in Florida, the law now requires you to sign a consent form in person. This form must be approved by the Florida Board of Medicine and signed with a licensed MD (Medical Doctor) or DO (Doctor of Osteopathic Medicine).
  • Virtual Care Continues (With Terms and Conditions): If you’ve already signed your in-person consent form, you’re good to go! You can keep receiving care virtually, but only from the specific provider with whom you signed the form. If you haven’t signed it yet, you’ll need to get that done first.
  • Upcoming In-Person Events: To help make this process as smooth as possible, we’re continuing to organize in-person events for those seeking GAHT to sign their consent forms. Our next series of events are on September 27-28, 2024. We will be releasing the details of these events soon, so stay tuned for more info on how to sign up.
  • MD or DO Requirement: RNs, APNs, and PAs currently can’t prescribe gender-affirming care or perform related procedures under these new laws. It has to be a licensed MD or DO.
